PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY. BY ACCESSING OR USING THIS WEBSITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS DESCRIBED HEREIN AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS WEB SITE.

Acceptance of Terms. Donuts-Democracy.org (“Donuts + Democracy,” “D+D,” “we,” “us,” “our”), including all site-related content and services provided by Donuts + Democracy (“we,” “us”). Your use of Donuts + Democracy is subject to your compliance with the terms and conditions set forth in this Terms of Use agreement (“Terms of Use”). 

By using D+D, you agree to be bound by the version of the Terms of Use then in effect. We reserve the right to update the terms and conditions at any time.

Communications from Donuts + Democracy. Based on the information you provide to us, we may contact you via email or SMS text messaging. If you do not want to be contacted, please email us at info@donuts-democracy.org.

Consent to Receive Text Messages. By providing your mobile number and opting in, you agree to be contacted by or on behalf of Donuts + Democracy at the provided mobile number. This includes text messages for informational, product, or service-related purposes (e.g., donation requests, advocacy actions, etc.). Message frequency varies, and standard message and data rates may apply.

To stop receiving text messages, reply with the word STOP. We may confirm your opt-out by text message.

Donuts + Democracy Proprietary Rights and Re-Use Policy. You acknowledge and agree that the information and materials presented on or through D+D will remain the property of D+D and its licensors or providers, and are protected by copyright, trademark, patent, and/or other proprietary rights and related laws, rules and regulations.

Trademarks. The trademarks, service marks, logos, and/or trade names displayed on Donuts + Democracy (collectively the “Marks”) are the registered and unregistered trademarks of D+D, its licensors and suppliers, and others. All Marks on D+D not owned by D+D are the property of their respective owners. The Marks owned by D+D, whether registered or unregistered, may not be used in connection with any product or service that is not D+D.  D+D logos may not be reused in any manner without explicit authorization from D+D.

Third Party Content

D+D may provide third party content on the Site and may provide links to Web pages and content of third parties (collectively the “Third Party Content”) as a service to those interested in this information. D+D does not control, endorse or adopt any Third Party Content and makes no representation or warranties of any kind regarding the Third Party Content, including without limitation regarding its accuracy or completeness. You acknowledge and agree that D+D is not responsible or liable in any manner for any Third Party Content and undertakes no responsibility to update or review any Third Party Content. Users use such Third Party Content contained therein at their own risk.

Submissions

You acknowledge and agree that any materials, including but not limited to questions, comments, suggestions, ideas, plans, notes, drawings, original or creative materials or other information, regarding the Site or D+D that are provided by you in the form of email or other submissions to D+D, or any postings on the Site, are non-confidential and shall become the sole property of D+D. D+D shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these materials for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

Limit on Use

Except as expressly permitted above, you may not copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, or in any way exploit any material produced by Donuts + Democracy.  You may not make any editorial changes to articles or materials without first receiving express permission from D+D. This provision does not restrict excerpting portions of content in a manner that does not alter the editorial intent. If any of these terms are breached, we reserve the right to withdraw your license to republish our material. In this situation, you must take immediate steps to remove our material from all current and past communications.

Disclaimer of Warranties

We do our best to provide accurate and helpful information. However, our Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that our Services will be error-free, uninterrupted, or secure.

Limitation of Liability

To the fullest extent permitted by law, D+D and its employees, directors, and officers are not responsible for any indirect, incidental, consequential, or punitive damages arising from your use of our Services, including lost profits, lost data, or personal injury. Your sole remedy if you are dissatisfied with our Services is to stop using them.

Indemnification

You agree to defend, indemnify, and hold harmless D+D and its employees, directors, and officers from any legal claims, damages, liabilities, or expenses (including reasonable attorneys' fees) arising from your use of our Services or your violation of these Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. You agree to resolve any dispute with D+D through binding arbitration in San Francisco, California, except that either party may bring eligible claims in small claims court.

Additional Legal Provisions:

No Assignment

  • You may not assign your rights or obligations under these Terms without D+D's prior express written consent.

Severability

  • If any provision of these Terms is found to be unenforceable, that provision will be construed as narrowly as possible to reflect the original intent, and the remaining provisions will continue in full force and effect.

No Waiver

  • D+D's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.

Privacy Policy

1. Scope of this Policy

Donuts + Democracy (“D+D,” “we,” “us,” “our”) respects your privacy and values your trust. The purpose of this Privacy Policy is to inform you of the treatment and handling of personal information that we may learn about you from using our website at donuts-democracy.org (the “Site”) and from engaging with the Site’s content (collectively, the “Services”). If you have any questions regarding this information or our privacy practices, please contact us via the methods set out in the How to Contact Us section at the end of this Privacy Policy.

2. Agreement to Terms

If you do not agree with the terms of this Privacy Policy and our Terms of Use, then you should immediately discontinue use of the Service without providing us with any personal information. 

3. Information we Collect

We may collect the following categories of personal information (a) directly from you (such as when you contact us, make a donation, contribution, or purchase, complete a survey, or complete a registration form), (b) from third parties, including, for example, our vendors or nonprofits, and advocacy organizations with whom we work, (c) from the device and browser that you use to access the Site, and (d) from cookies and similar technologies. 

In addition, the government campaign finance regulators or other agencies may require us to collect certain personal information from donors. For example, the Federal Election Commission (FEC) requires us to collect (and disclose to them) the name, mailing address, occupation, and employer of all individuals whose donations to the Youth Progressive Action Catalyst, a Federal Hybrid PAC, exceed $200 per calendar year. 

Identifiers. We may collect your first name, last name, email address, phone number,  postal address, employer and occupation.

Inferences. We may also draw inferences from the information that we collect that reflect your preferences, characteristics, and interests.

Device Information. We may collect device information when you visit the Site. Device information may include unique personal identifiers, online identifiers, IP address, browser type, device type, and access times.

Internet Activity. We may collect information concerning your interaction with the Site, including when you access the Site and your browsing activity on the Site (such as which pages you visit, in what order, and for how long). This may also include “traffic data” or tracking information provided by the Site’s host or similar providers (e.g., Google Analytics) that may be helpful for marketing purposes or for improving the Site and App.

You are not required to provide all personal information identified in this Privacy Policy to use our Service or to interact with us, but certain functionality will not be available if you do not provide certain personal information. For example, if you do not provide certain personal information, we may not be able to respond to your requests.

4. Cookies

We store certain information that gets collected automatically at our end through cookies and other similar technologies. A cookie is a small string of information that a website that you visit transfers to your browser for identification purposes. Cookies can be used to follow your activity while using a website or across websites, and that information helps companies understand your preferences and tendencies, as well as improve and personalize your website experience. Some cookies are necessary to operate a website, while others can be functional, analytical, or used for marketing purposes, including targeted advertising (as discussed in more detail below). Cookies on the Site are generally divided into the following categories:

Strictly Necessary Cookies. These are required for the operation of the Site. They include, for example, cookies that track whether you have accepted the Site’s cookie notice.

These allow us to recognize and count the number of visitors to the Site and understand how such users navigate through the Site (e.g., when and which pages are visited, in what order the pages are visited, and where a user is located). Marketing Cookies. These record your visit to the Site, the pages you have visited, and the links you have followed to recognize you as a previous visitor, and to track your activity on the Site and other websites you visit. These cookies are used to display ads on other websites based on your visits to the Site and other online activity. These cookies qualify as persistent cookies because they remain on your device. You can opt out of these cookies through our cookie banner. If you opt-out, you will need to apply these opt-out settings in each browser and device from which you wish to opt out. If you opt-out of interest-based advertisements, you will still see advertisements online, but they may be less relevant to you.

We also use third parties to provide certain features or functionality through the Service. For example, we use Action Network for marketing services. You can learn more about Action Network’s Privacy Notice at https://actionnetwork.org/privacy.

You can also prevent the use of certain cookies by modifying your Internet browser settings, typically under the sections “Help,” “Internet Options,” or “Settings.” If you disable or delete certain cookies in your Internet browser settings, you may still access our Site, however, you might not be able to access or use important functions or features of our Site, and you may, for example, be required to re-enter your log-in details.

Do-Not-Track Signals. At this time, D+D does not recognize automated browser signals regarding tracking mechanisms, which may include “do-not-track” instructions.

5. Children’s Privacy

The Service is not intended for users under the age of 13 and D+D does not knowingly collect personal information from individuals under the age of 13. If you are aware of, or suspect that, someone under the age of 13 is using the Service without permission, please notify us immediately by contacting us as detailed below. If you have questions or concerns about the Internet and privacy for your child, we encourage you to check out the FTC Guidelines for protecting your child’s privacy online. 

6. Our Use of Personal Information

We collect and use your personal information for the following purposes:

  • Providing the Service to you and providing services requested by, or reasonably anticipated within the context of our relationship with, you;

  • Managing our relationship with you;

  • Responding to your inquiries or requests, and requesting feedback;

  • Administering promotions, events, or surveys;

  • Providing promotional material or other marketing materials that we believe will be of interest to you;

  • Tailoring advertisements to what we or our advertising partners believe may be of interest to you (including working with our advertising partners to display advertisements on third-party websites that you may visit); 

  • Voter registration and civic engagement through our Voting Hub, including helping you register to vote, pre-register, look up your polling place, and use our other voter tools; sending you election reminders, deadline alerts, and voting-related information; helping you check or complete your registration status; and fulfilling other services you request through our tools;

  • Support academic studies and research about voter behavior. Any information shared with researchers is aggregated and de-identified—it cannot be used to identify any individual user;

  • Analyzing use of the Site; to help connect you with other supporters, and to solicit volunteers, donations, and support for D+D and for issues, events, and organizations that we support; to remind you to send in your voter registration form and to vote, and to assist you in finding your voter registration information and polling location;

  • Detecting security incidents and protecting against malicious, deceptive, fraudulent, or illegal activity, or prosecuting those responsible; and

  • Complying with campaign finance disclosure obligations, Federal election laws and other legal and regulatory obligations.

7. Our Disclosure of Personal Information

We may share your personal information, including collected text messaging originator opt-in data, with the following third parties:

  • Service providers, including consultants, vendors, hosting providers and IT outsourcing, contact management software providers, customer relationship management providers, and marketing providers. In some instances, service providers will be directly responsible to you for their use of your personal information. They may be obliged by law to provide you with additional information regarding the personal information that they hold about you and how and why they process that information. Further information may be provided to you in a separate notice or may be obtained from such service providers directly, for example, via their websites.

  • Advertising networks, to provide you with marketing that we or our advertising partners believe will be relevant to you.

  • With third parties in connection with, or during negotiations of, any change to the control or financial status of D+D, including a restructuring, sale, acquisition, financing, reorganization, bankruptcy, receivership, transfer, or assignment of assets or merger or divestiture. Personal information and other information may be shared in the diligence process with counterparties and others assisting with the transaction and transferred to a successor or affiliate as part of that transaction.

  • Other government bodies, dispute resolution organizations, law enforcement agencies, or third parties in connection with (a) responding to a subpoena, search warrant, or other lawful request for information we receive; (b) cooperating in a law enforcement or similar investigation; or (c) otherwise protecting our rights, as applicable.

  • Allied organizations, groups or causes that we believe have similar viewpoints, principles, or objectives. 

  • The Federal Election Commission, to report your name, mailing address, occupation, and name of employer in connection with contributions to Youth Progressive Action Catalyst, a registered Federal Hybrid PAC that exceed $200 in a calendar year (for additional information, visit the FEC website at https://www.fec.gov/).

  • As required under federal or state law.

  • With your consent or at your direction.

8. Your Privacy Choices

If you no longer want to receive our newsletter, emails, or other marketing communications, you may unsubscribe at any time by following the unsubscribe options in the communication itself or by emailing us at the contact information below under How to Contact Us. To opt-out of text messages, you may text “STOP” in reply to any D+D marketing text message. Please note that you cannot unsubscribe from certain correspondence from us, including messages we send in response to an inquiry from you.  

9. Security

We maintain reasonable technical and organizational measures to protect personal information from loss, misuse, alteration, or unintentional destruction. We have implemented various security measures to protect both the personal information and the general information that we receive from you through the Service. Whenever you give out personal information online there is a risk that third parties may intercept and use that information. Although we seek to protect your personal information and privacy, we cannot guarantee the security of any information you disclose online. To the extent permitted under applicable law, we assume no liability or responsibility for disclosure of your information due to errors in transmission, unauthorized access by third parties, or other causes beyond our control.

10. Links to other websites

For your convenience, we may link to third-party sites and services, or otherwise display third-party content through our Site to provide increased value to our visitors. These include, for example, voteamerica.org, futurevoter.com, actblue.com, zoom.com and mobilize.us as well as other third-party sites and services. We have no control over these linked sites, each of which has separate privacy and data collection policies and practices independent from us. As such we have no responsibility or liability for these independent policies or actions and are not responsible for the privacy practices or the content of any such websites. Please note that these other sites may send their own cookies to users, collect data, or solicit personal information, and we encourage you to review their policies before engaging with these third-party sites.

11. Effective Date & Changes to this privacy policy

This Privacy Policy is effective as of the date at the top of this policy. D+D has the discretion to update this Privacy Policy at any time. When we do, we will revise the effective date at the top of this page. We encourage users to frequently check this page for any changes and to stay informed about how we are helping to protect the personal information we collect, especially before you provide information, and particularly personal information, directly to us through the Service. In the event of a material change to this Privacy Policy, we will provide a message through our website or via email informing you of the change.
